Litigation is the legal process used when disputes cannot be resolved out of court by parties through negotiation or other forms of alternative dispute resolution. At Kain and Ball, our experienced family law lawyers are here to help you whether you have been served with an Application or need to bring an Application to commence litigation. While litigation is not the ideal way to resolve all family law disputes, there are circumstances that require immediate action, where litigation needs to be commenced as soon as possible. These circumstances include asserting claims for interim relief regarding child support, spousal support, child custody and access, restraining orders, or exclusive possession of the matrimonial home. If you find yourself in a position where you need an interim court order for this type of relief, you should seek advice from a qualified family law lawyer as soon as possible.
It is important to remember that just because litigation has been initiated, this does not mean that the matter will proceed all the way to trial. In fact, often, cases settle out of court even though an application has been brought. There are many steps in the litigation process that require the parties and their counsel to come together in court for various attendances (Case Conferences, Settlement Conferences, Trial Management Conferences etc.) which are meant to foster settlement.
At Kain and Ball Family Law, we make every effort to continuously work towards a mutually acceptable agreement while representing your interests. We believe it is in everyone’s best interests to resolve family law matters as amicably and efficiently as possible; however, sometimes it is necessary for matters to proceed to trial because unfortunately, it is not always possible to reach an agreement. Although we do our utmost to help our clients avoid the cost and conflict inherent in litigation, when the time comes to go to court, we are ready. Our legal team of accomplished advocates and excellent litigators has successfully represented many clients at trial, and will fight for you.
Whether you have been served with an application or need to start the litigation process, the experienced and knowledgeable family law lawyers at Kain and Ball are here to help you throughout the entire process.
